Terms & Conditions

These terms and conditions govern all accommodations (“Accommodations”) provided by Eagle Pass Heliskiing Ltd. (operating as Eagle Pass Lodge) (“EPL”) to any person (a “Guest”).

Facility Rules (included herein) apply to all Accommodations.

A travel agent or other booking agent selling Accommodations is acting as a limited agent of EPL. If the terms and conditions of Accommodations presented by any such agent differ from these terms and conditions, these terms and conditions prevail.

EPL disclaims any responsibility or liability for services coordinated by EPL but provided by third parties, including without limitation recreational activities, equipment rentals, and transportation.

Bookings

A Guest’s booking of Accommodations (a “Booking”) is confirmed when (1) EPL confirms such Booking in writing and (2) EPL receives full payment of the Deposit (defined below).

At the time of booking Accommodations for a date more than 30 days in the future:

1.     the Guest shall pay EPL a non-refundable deposit of 30% of the total price and applicable taxes (the “Deposit”); and

2.     the Guest shall pay the remainder of the total price and applicable taxes (the “Balance”) no later than 30 days prior to the Guest’s arrival date.

At the time of booking Accommodations for a date 30 days or less in the future, the Deposit and Balance are due at the time of Booking.

All payments are in Canadian dollars. Taxes apply, and taxes are not included in any listed package price.

EPL accepts Visa, Mastercard, American Express, bank transfers, cheques, and Interac transfers.

Cancellations

Cancellation by EPL

EPL may cancel a Booking at any time up to and including a Guest’s date of arrival. If EPL cancels, EPL shall notify the Guest via the email address provided at the time of Booking. If EPL cancels, EPL shall refund the Deposit and any Balance paid, in full.

EPL may terminate any Booking at any time without refund or other compensation of any kind if EPL finds, in its sole discretion, that a Guest has not complied with these terms and conditions, any further terms and conditions communicated by EPL at any time, any applicable law, or if EPL deem that it is unable to ensure the safety the Guests at all times.

Cancellation by Guest

A Guest may cancel a Booking via email to info@eaglepasslodge.ca. A cancellation is effective upon written confirmation by EPL.

If a Guest cancels a Booking at least 30 days prior to the Guest’s date of arrival:

1.     the Deposit will be held by EPL and may be applied by the Guest to a future Booking within the next 24 months; and

2.     EPL shall refund the Balance, subject to an administrative fee of 5% of any refunded amount.

If a Guest cancels a Booking less than 30 days prior to the Guest’s date of arrival, the Deposit and Balance are forfeited to EPL.

Risk

Guests are solely responsible for travel to and from EPL grounds and facilities.

If a Guest is unable to participate in a Booking for any reason whatsoever, whether within the control of the Guest or not, including without limitation reasons related to travel issues, closed borders, weather, limitations on available services due to outages or emergency situations, or transportation closures, the Guest will be deemed to have cancelled and the cancellation policy will apply.

Despite the foregoing, if a Guest is unable to participate in a Booking due directly to COVID-19, EPL shall refund the Deposit and Balance in full, subject to an administrative fee of 5% of the refunded amount.

Accommodations Terms

Damage Deposit

EPL requires a $2,000 damage deposit in respect of each group of one or more Guests at the time of checking-in. EPL shall return the deposit after departure of the last Guest to which the damage deposit applies and after satisfactory inspection by EPL. Guests are responsible for all damage to EPL grounds and facilities, including in excess of the damage deposit.

Additional Services

Payment for additional services and incidental costs incurred by Guests (e.g. shuttle service, massages, purchased alcohol) is immediately due and payable at check-out time.

Check-in and Check-out Times

Guest check-in time is 4:00 pm. Guest check-out time is 11:00 am. EPL charges a fee for late check-outs.

Storage of Valuables

EPL provides a safe for storage of any Guest valuables. EPL disclaims any responsibility or liability in connection with valuables not provided to EPL for storage in the safe.

Room Keys

Guests will be charged a $25.00 fee for each lost room key at the time of check-out.

Liability

Despite anything to the contrary, the liability of EPL in connection with a Booking or Accommodations is limited to the amount, exclusive of taxes, received by EPL from the Guest in respect of the Booking or Accommodations.


Facility Rules

These facility rules apply to all Accommodations. EPL may terminate the Booking and Accommodations of any Guest for failure to comply with these facility rules.

Alcohol 

EPL requires adequate proof-of-age documentation prior to serving any Guest alcohol.

EPL may refuse to serve alcohol to any Guest for any reason whatsoever. EPL may require any inebriated Guest to leave EPL grounds and facilities at their own expense.

Any Guest bringing alcohol on to EPL grounds or facilities must have prior approval of EPL. EPL may charge a fee in connection with such approval.

Guest may only consume alcohol on EPL grounds or facilities in designated areas.

EPL ceases serving alcohol and closes the bar area at midnight.

Illegal Substances

EPL does not permit illegal substances in the EPL grounds or facilities.

Smoking

EPL facilities are completely smoke-free. In addition to any other consequence, EPL may charge each Guest failing to comply with this policy a $500.00 cleaning fee for each failure.

Hot Tub & Sauna

EPL requires proper swimwear in the hot tub, sauna, and surrounding areas. The hot tub and sauna close at 10pm.

Pets 

EPL does not permit pets of any kind in the facilities, dogs on site are permitted in some cases. Decisions of the management are final.
